Mandatory Summary Judgments

Efforts to reform tort law in the courts must walk a fine line between legitimate efforts to reduce court case loads and a reduction in citizens’ rights to seek compensation for damages in an impartial forum. Any tort reform runs the risk of decreasing court accessibility to those with little in the way of expendable resources. One way of decreasing frivolous lawsuits without limiting accessibility to the courts is to make a summary judgment regarding the validity of the case to be mandatory prior to the case being moved to jury trial. “No-evidence” summary judgments may be utilized to require the plaintiff in a case to prove that there is sufficient evidence to move a case to trial. By placing the burden of proof upon the plaintiff, attorneys are likely to bring before the court only cases in which sufficient evidence to move the case to trial exists.
